Privacy Policy

1. Introduction

People ATX LLC ("People ATX," "we," "our," or "us") is an executive search and advisory firm. We take the privacy of the people whose information we handle seriously, including candidates, whose careers can be affected by how their information is used.

This Privacy Policy ("Policy") explains what personal information we collect, where we get it, why we use it, who we share it with, how long we keep it, and what you can ask us to do. "Personal information" in this Policy includes information that identifies, relates to, describes, or could reasonably be linked with a particular individual or household. If we have contacted you about a job search, Section 6 is written for you.

3. Where We Get Potential Candidate Information

Directly from you. When you complete a form, email or call us, send a resume or CV, subscribe to The People Brief, request the talent report, join an Academy list, take part in an interview or assessment.

From third parties and public sources. Executive search requires us to identify people who have not applied for anything, so we routinely collect information about candidates from sources other than the candidate, including:

What we do not collect. We do not ask for Social Security or other government identification numbers, bank account or credit card details, or health information. We do not ask candidates for salary history. Please do not send us any of these.

5. Why We Use Personal Information

We do not sell personal information for money. See Section 11 on what "sale" and "sharing" mean under state privacy laws.

6. If We Have Contacted You About a Search to Job Candidates

How we found you. Executive search means we find people who have not applied for anything. In most cases, we found you before you ever heard from us, usually through your public professional profile, your employer's website, news coverage, or a referral. If you want to know specifically where we got your information, ask us.

What we collect. Your background and how to reach you; what we learn in conversations with you and from references; and what you tell us you are looking for. We will never ask for your Social Security number, bank or credit card details, or health information.

What we do with the information provided by you. We assess whether you fit a search we are running, present you to our client if you agree, and stay in touch about future opportunities.

We will not send your information to a client without telling you first and getting your agreement. That includes the first time we mention you by name.

If a search is confidential, we may not be able to tell you who the client is until later. We will tell you that is the situation rather than avoid the question.

References. If we request formal references from you, we will agree with you first on who we speak to and when. From time to time, we may also obtain informal references or other information about you from individuals who are not identified as formal references. If you have provided a reference for someone else, we will not disclose to a client which reference provided specific information unless that reference has agreed to us doing so.

Recording. If we want to record or transcribe a conversation with you, we will ask first. You can say no and ask not to be recorded. Saying no will not affect your candidacy.

What you can ask us to do. Tell you what we have, correct your information, delete your information, stop contacting you about a job search or entirely, or take you out of our network.

Asking us for any of this will not count against you. If you ask to be removed and later want to be considered for something, you are welcome to come back.

7. Sensitive Information

We do not ask for sensitive personal information, and we ask that you not send it, including Social Security or other government identification numbers, financial account information, health or medical information, genetic or biometric data, precise geolocation, racial or ethnic origin, religious beliefs, sexual orientation, union membership, or criminal history. If you send us sensitive information we did not request, we will delete or return it where practicable.

Background checks. Where a client requires a background check, consumer report or credential verification, that check is conducted by the client or by a consumer reporting agency the client engages. People ATX does not procure, receive, or retain the report.

8. Artificial Intelligence and Automated Decision-Making

We use technology, including artificial intelligence tools, to help us research, organize information, and work efficiently. We want to be clear about what that does and does not mean.

Research and drafting support only.

We use AI tools to help search public sources, summarize publicly available background, organize notes, and draft correspondence. We do not use AI to score, rank, screen out, or make decisions about candidates. A partner reads your background, and a partner makes every assessment and every recommendation to a client. AI output is reviewed by a person before it is used.

Recordings. If we record or transcribe an interview or meeting using an AI notetaker, we will tell you and obtain your agreement first. You may decline, and declining will not affect your candidacy.

9. Who We Share Personal Information With

Clients. If you are a candidate in an active search, we share your profile, background, assessment, and reference feedback with the client for that search. We will tell you before we present you and will not present you without your agreement. Once shared, the client handles your information under its own policies, which we do not control.

Service providers. Third parties that process personal information only to provide services to us, such as applicant tracking/candidate relationship management systems, email and marketing platforms, cloud storage and productivity, video conferencing, scheduling, website hosting and analytics, podcast hosting, and professional advisors (attorneys, accountants, insurers).

References and sources. When taking references we identify the candidate and that we are conducting a search. We do not attribute a reference’s feedback to a named reference in our reporting to a client unless that reference agrees.

Legal and safety. Courts, regulators, and law enforcement where required by law or legal process, and where necessary to investigate fraud, protect our rights, or protect anyone's safety.

Corporate transactions. A prospective or actual acquirer, investor, or successor, subject to confidentiality protections.

Our personnel on a need-to-know basis.

We do not sell your personal information for money, and we do not disclose it to third parties for their own direct marketing.

10. Your Rights and Choices

How to ask. Email hello@peopleatx.com with "Privacy Request" in the subject line. We will acknowledge within 10 days and respond within 45 days, extendable once by a further 45 days where reasonably necessary. We will tell you if we need the extension. We will take reasonable steps to verify your identity and will collect only the minimum information needed to do so.

Appeals. If we deny your request we will explain why, and you may appeal by replying to our response or writing to hello@peopleatx.com with "Privacy Appeal" in the subject line. We will respond within 60 days.

No retaliation. We will not treat you adversely for exercising any of these rights. Declining to be considered, or asking us to delete your information, will not prejudice you in any current or future search.

Marketing email. You can unsubscribe using the link in any marketing email, or by writing to hello@peopleatx.com. We honor unsubscribe requests as required by the CAN-SPAM Act.

11. Cookies, Analytics, and Advertising

The Site uses cookies and similar technologies for strictly necessary functions, analytics, and marketing.

"Sale" and "sharing." We do not sell personal information for money. But several state privacy laws define "sale," "sharing," and "targeted advertising" broadly enough to cover third-party advertising and analytics tags, including the LinkedIn Insight Tag, Meta Pixel, and Google Ads tags. To the extent we use these, that may be a "sale" or "sharing" under those laws, and you may opt out.

How to opt out with us. Email hello@peopleatx.com with "Do Not Sell or Share" in the subject line and we will stop sharing your information with advertising and analytics partners. We will confirm when it is done.

12. Text Messages

Consent. We send text messages only to people who have opted in, whether in writing or verbally during a conversation with us. Phone numbers collected for SMS are not used for our marketing purposes or shared with third parties or affiliates for marketing purposes.

What we send. Follow-up messages about a conversation, interview scheduling and reminders, and updates on a search you are part of.

Example: "Hi, this is a reminder of your call with People ATX on [date] at [time]. Reply STOP to opt out."

Frequency. Varies by what is happening in your search; typically no more than a few messages per week.

Cost. Message and data rates may apply, depending on your carrier and plan.

Opting out. Reply STOP to any message at any time. You may also email hello@peopleatx.com to stop receiving text messages from us.

Help. Reply HELP, or email hello@peopleatx.com.

If you prefer not to receive texts, simply do not check the SMS consent box on our forms.

Declining will not affect your candidacy.

13. Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration, and destruction, including access controls, multi-factor authentication, and vendor due diligence. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

14. How Long We Keep Personal Information

We keep personal information for as long as we have a business reason to, judged by: whether we still have an ongoing relationship with you; whether we need it to meet a legal, tax, or accounting obligation; and whether we may need it to establish, exercise, or defend a legal claim.

When we no longer have a business reason to keep information, we delete or anonymize it. Where deletion is not immediately possible, for example in backups, we isolate it from further processing until it is.

If you ask us to delete your information, we keep a minimal suppression record, so we do not find you again from a public source and add you back.

15. Children

The Site is not directed to children, and we do not knowingly collect personal information from anyone under 18 years old, or sell or share the personal information of anyone under 18. If we learn we have collected information from a child under 18, we will delete it. If you believe that has happened, contact hello@peopleatx.com.

16. Third-Party Sites and Services

The Site links to and embeds third-party services. We do not control them and are not responsible for their privacy practices. Review their policies before providing information.

17. Where We Operate

Our services are directed to the United States. We store personal information in the United States, and we do not offer services to, or seek to monitor, individuals located in the European Economic Area, the United Kingdom, or Switzerland.

18. Changes to This Policy

We may update this Policy. We will post the revised version with a new "Last Updated" date, and if the changes are material, notify subscribers by email or post a notice on the homepage. Changes take effect when posted.
